User Agreement - Version 2: May 11, 2010

This User Agreement (the "Agreement") sets out the terms on which Yukon Trader and our subsidiaries, affiliates, directors, agents, and employees (collectively, "Yukon Trader") offers you (the "User") access to the services provided on yukontrader.ca, yukontrader.com and their subdomains (the "Site"). If you do not agree to be bound by the terms and conditions of the Agreement, you may not use the Site or access its services.

You must read, agree with and accept all of the terms and conditions contained in this Agreement before you may become a member of the Site, or submit an Event, Classified or Advertisement (an "Item") to the Site.

Yukon Trader may amend the Agreement at any time by posting the amended terms on the Site. All amended terms shall be effective 48 hours after they are posted on the Site.

1. Fees and Services:

   Joining the Site, submitting Items to the Site and viewing Items on the Site is free of charge. Yukon Trader may charge a fee for posting certain Items. The User will have an opportunity to review and accept any fee that may be charged. All fees are in Canadian Dollars. The User is responsible for paying all fees associated with using the Site and all applicable taxes.

2. Listing and Selling:

   The User must be able and willing to provide the products or services posted to the Site. When posting, the User must accurately describe the product or service and terms of its sale. Yukon Trader reserves the right to remove or edit any Item posted to the Site.

3. Contacting Site Users:

   The contact information posted with an Item may only be used to contact the poster expressing interest or intent to buy regarding that Item. Any other use, such as advertising or soliciting, is strictly prohibited.

4. Collection of Personal Information:

   "Personal Information" is defined as any information about an identifiable individual, as further defined under applicable Canadian law. This includes contact information such as name and email address, and demographic information such as postal code and age.
   Personal Information may be provided by the User to the Site during the registration and posting processes. The User is responsible for the accuracy of their submitted Personal Information. The User agrees that their Personal Information will be displayed on the website alongside their posted Item. The Personal Information appearing with an Item is chosen by the User.

5. Disclosure of Personal Information:

   Yukon Trader may disclose certain Personal Information to law enforcement agencies for the purposes of investigating fraud or other offences. Yukon Trader will not sell or rent any Personal Information to any other agency.

6. Use of the Site

   The content provided by the Site is intended for personal and non-commercial use. The User may view and print out web pages from the Site for personal use, provided that you maintain all copyright notices, but may not otherwise copy, reproduce, modify, collect, or catalogue information or material on the Site, except as expressly permitted by Yukon Trader.

   The User may not use the Site to engage in any unlawful activity or to infringe the rights of Yukon Trader or others.

   The User will not (a) interfere with the operation of the Site in any way, (b) interfere with anyone's use or enjoyment of the Site, (c) harass anyone on the Site or through the Site, or (d) impersonate any person or entity on the Site or through the Site.

   Information submitted to the Site shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of counterfeit or stolen items; (c) infringe upon any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, antidiscrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain pornography or, if otherwise adult in nature or harmful to minors, shall not be posted; (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and (i) link directly or indirectly to or include descriptions of goods or services that: (aa) are prohibited under this Agreement; (bb) you do not have a right to link to or include. Furthermore, the User may not list any item on the Site that, by paying to us the listing fee, could cause violation of any applicable law, statute, ordinance or regulation.

7. No Warranty:

   Yukon Trader provides the Site and services "as is" and without any representation, warranty or condition, express, implied or statutory. Yukon Trader specifically disclaims any implied representation, warranties of title, merchantability, merchantable quality, and fitness for a particular purpose.

8. No Liability:

   In no event shall Yukon Trader be liable for lost profits or any special, incidental, consequential, indirect or punitive damages arising out of or in connection with the Site, our services or this agreement.

9. Legal Compliance:

   The User shall comply with all applicable laws, statutes, ordinances and regulations regarding use of Yukon Trader's service and the listing, purchase, solicitation of offers to purchase, and sale of items.

10. No Agency:

    The User and Yukon Trader are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement.

11. Resolution of Disputes:

    If a dispute arises between the User and Yukon Trader, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, the user and Yukon Trader agree that any claim or controversy of law or equity that arises out of this Agreement or use of the Site ("Claims") shall be resolved as mutually agreed upon in writing by the parties. We strongly encourage the User to contact Yukon Trader directly to seek a resolution if a dispute arises, and we will consider alternative dispute resolution procedures as an alternative to litigation.

12. General:

    This Agreement shall be governed in all respects by the laws of the Yukon Territory and the federal laws of Canada applicable therein. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our Site may be interfered with by numerous factors outside of our control. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

13. Contracts in English:

    It is the express wish of Yukon Trader that this document and any related documents be drawn up and executed in English.
